Terms and Conditions for Farmers

Thank you for your interest in partnering with Krushipandit Agro Care Pvt. Ltd. By submitting this form, you (“the Farmer” or “Member”) agree to a three-year exclusive agreement, valid until [Contract End Date], governed by the terms and conditions outlined below.
1. Security Requirements:

You agree to submit:

  • Two blank cheques, duly signed and crossed in favor of Krushipandit Agro Care Pvt. Ltd., drawn on a nationalized bank.

  • A covering letter on official letterhead confirming that these cheques are being provided for security purposes only, and will be used solely in case of payment default.

  • Supporting documents including partnership deed/income tax return, 7/12 extract, 8A extract, address proof, contact details, Aadhar Card, Ration Card, and passport-size photos.

2. Product Pricing:
  • All products will be sold at wholesale market prices.

  • Additional charges such as GST, taxes, duties, and service fees will apply separately.

  • No other discounts shall apply unless expressly approved in writing by the company.

  • The company reserves the right to revise pricing and terms based on changes in the market or business conditions.

3. Payment Terms:
  • All payments must be made as per the invoice terms issued with each delivery.

  • Delayed payments will incur interest charges, calculated from the due date until the payment realization.

  • Cheques must clear within 5 working days of deposit. If it takes longer than 8 working days, a 2% interest per delayed period will apply.

4. Discounts:
  • Only net cash-based discounts will be applicable.

  • All promotional schemes or special offers will be honored only if approved in writing.

5. Cash Handling Policy:
  • No cash shall be handed over to field staff, salespersons, or development officers without written authorization from the head office.

  • The company holds no responsibility for any unauthorized cash transactions.

6. Return Policy:
  • All products are sold on a non-returnable basis. Orders should be placed after verifying your requirements.

  • If any product with a shelf life of less than six months is received, it must be reported and returned within 10 days of delivery with written notice.

  • Any goods received without a formal purchase order must be reported and returned within 7 days. Otherwise, they will be considered accepted.

7. Bounced Cheque Policy:
  • A penalty of INR 2,000/- per bounced cheque will be levied, in addition to standard bank charges.

  • If more than two cheques bounce during the contract period, the company reserves the right to revoke any discounts, schemes, and ongoing supply arrangements.

8. Product Quality Disclaimer:
  • All products are manufactured to high quality standards, and wherever applicable, are ISO certified.

  • Products are safe and effective when used as recommended.

  • However, since the company cannot control usage and application, it shall not be liable for any direct or indirect damage arising from improper or unintended use.

9. Legal Costs:

In the event of any legal action arising in your designated operational area, you agree to bear 50% of the legal fees of the company’s appointed lawyer, in addition to any other applicable legal expenses.

10. Authority Limitation:

Nothing in this agreement authorizes you to incur any expense or obligation on behalf of the company, unless explicitly authorized in writing.

11. Assignment:

You shall not assign, transfer, or delegate any of your rights, duties, or obligations under this agreement without prior written consent from the company.

12. Notifications:

You agree to notify the company in writing at least 10 days in advance regarding any change in your:

  • Business location

  • Telephone or mobile number

  • Ownership or management structure

Any communication sent to your last known address on record will be deemed to be properly delivered.

13. Termination:

Either party may terminate this agreement by providing 30 days’ written notice. However, in the event of termination initiated by you, all pending dues including interest must be cleared before the contract is considered concluded.

14. Legal Compliance:

You agree to comply with all applicable laws, including but not limited to:

  • The Fertilizer Control Order, 1985

  • The Standards of Weights and Measures (Packaged Commodities) Rules, 1977

  • Relevant rules and guidelines issued by central, state, and municipal authorities from time to time

15. Final Declaration:

You are kindly requested to read the above terms and conditions carefully. By signing this agreement, you confirm your acceptance, allowing us to register this contract with the appropriate government authority in your region.
